J Gautam Patel Highlights Legal Challenges of AI in Copyright & Trademark Law

The former Bombay HC judge, recently addressed AI’s impact on copyright and trademark law, highlighting challenges like deepfakes, copyright ownership in AI-generated works, and AI’s role in trademark protection and infringement detection. 

Justice Gautam Patel raised concerns over copyright ownership in AI-generated works, citing ANI’s lawsuit against OpenAI. He argued that AI, now a creator, challenges traditional copyright laws and the "sweat of the brow" principle. 

Justice Gautam Patel suggested brands must use AI to monitor online infringements and counter deepfakes, offering a solution for companies to protect their intellectual property in an increasingly AI-dominated landscape.
