J&K High Court Cancels MBBS Admission Over Fraudulent EWS Claim

  • Case Name: Ansh Mahajan Vs UT Of J&K

The J&K HC has ruled that individuals already holding a reserved category certificate, such as SC, ST, or RBA, are ineligible for the Economically Weaker Sections (EWS) quota.

The court canceled the MBBS admission of Mohd. Umar Farooq, who secured a seat using an EWS certificate despite holding an RBA reservation.

The ruling came in response to a petition by Ansh Mahajan, who scored 404 marks in NEET-UG 2024 and challenged Farooq’s admission, arguing it deprived him of his rightful seat.

The court held that Farooq fraudulently obtained the EWS certificate.

JKBOPEE was directed to reallocate the seat to the next eligible candidate and ruled that benefits secured through misrepresentation are void ab initio.
