J&K High Court Clarifies That Writ Courts Cannot Examine Revenue Mutations Without Specific Challenge

The Jammu & Kashmir High Court held that a writ court cannot examine the validity of revenue mutations or make observations on their attestation unless such mutations are specifically challenged in the petition.

It observed that mutation proceedings are limited in scope and primarily fiscal in nature, and do not determine title or ownership rights.

The Court emphasised that issues relating to mutation must be directly and properly contested before the competent forum.

In the absence of a specific challenge, the writ court should not go into their legality. Accordingly, the Court declined to interfere in the matter.
