
The Jammu & Kashmir and Ladakh High Court has refused to quash criminal proceedings initiated against officials of Banaskantha District Cooperative Milk Producers’ Union Ltd. (Amul) in an unsafe milk case.
Justice Wasim Sadiq Nargal held that the report of the Referral Food Laboratory declaring the milk sample “unsafe” overrides the earlier Food Analyst’s report and provides sufficient grounds for prosecution under the Food Safety and Standards Act, 2006.
The Court observed that matters involving food safety and public health cannot be subordinated to commercial interests or procedural objections, particularly in products widely consumed by children and infants.
