Call Records Alone Insufficient to Prove NDPS Offence, Rules Jammu, Kashmir and Ladakh High Court

The Jammu and Kashmir and Ladakh High Court granted bail to an accused under the NDPS Act, ruling that mere call records showing contact with a co-accused cannot establish involvement in drug trafficking without corroborative evidence such as voice recordings.

The Court observed that while two individuals were apprehended with narcotic drugs meant for delivery to Anantnag, the only evidence linking the petitioner was call data and inadmissible confessions under Section 67 of the NDPS Act. Finding this insufficient, the Court ordered his release on bail.
