J&K&L High Court: Call Logs Alone Cannot Prove Drug Conspiracy

The Jammu & Kashmir and Ladakh High Court granted bail to a man accused in a heroin trafficking case, holding that mere call detail records (CDRs) showing contact with co-accused cannot establish a criminal conspiracy under the NDPS Act without voice recordings or conversation transcripts.

Justice MA Chowdhary observed that phone logs alone do not prove involvement in drug trafficking, especially when no contraband was recovered from the accused.

The Court noted that the prosecution primarily relied on disclosure statements of co-accused and call records.

Relying on earlier Supreme Court and Delhi High Court rulings, the Court held that such evidence was insufficient to deny bail.
