
Justice BV Nagarathna of the Supreme Court has emphasised the need to implement mediation as a method of dispute resolution beyond commercial disputes.
While speaking at the 2nd National Mediation Conference on 'Enhancing the Eco-System for Mediation in India,' she observed that matters relating to environment, healthcare, intellectual property and as well as juvenile justice could be resolved using mediation.
She suggested that implementing this method required assessing on-ground realities and preparing an action plan within the state-centric criminal justice system.
Concluding her address, Justice Nagarathna stated, “Mediation must be seen not as a secondary option, but as a legitimate and powerful first resort in resolving disputes.”
