Justice Ujjal Bhuyan Says Constitutional Morality Must Prevail Over Majoritarian Views

Justice Ujjal Bhuyan stated that constitutional morality requires governance by the rule of law, not by popular will.

Speaking at a seminar in Hyderabad, he emphasised that constitutional courts must prioritise constitutional values over public or majoritarian morality.

Referring to Naz Foundation v. Government of NCT of Delhi and its affirmation in Navtej Singh Johar v. Union of India, he noted that constitutionality- not dominant opinion- guides judicial review.

Justice Bhuyan also underscored judicial independence, Article 227’s limited supervisory role, and praised growing women representation in Telangana’s judiciary, calling for a more inclusive “rainbow institution.”
