Karnataka High Court Dismisses Plea Against MP Prabha Mallikarjun Over Bribery Allegations

The Karnataka High Court has dismissed an election petition challenging the election of Congress MP Prabha Mallikarjun from Davanagere constituency in the 2024 Lok Sabha polls.

Justice M I Arun held that allegations of bribery made on April 6, 2024, prior to Mallikarjun’s nomination on April 12, cannot be termed “corrupt practice” under Section 123  of the Representation of the People Act, 1951, as a person becomes a candidate only upon filing a nomination under Section 79(b).

The Court allowed Mallikarjun’s application under Order VII Rule 11(a) CPC read with Section 86(1) RP Act, dismissing the petition for want of cause of action.
