Karnataka HC Denies Bail to Rape Accused, Affirms Chargesheet Filing Stops Statutory Bail Right

  • Case Name: Moulali Challal v. State of Karnataka

The Karnataka High Court denied bail to a rape accused, stating that once the chargesheet is filed well within the ambit of Section 193(2) of the BNSS, it means within the 60 days, the right to statutory bail automatically ceases.

The accused claimed the chargesheet was filed late, but the court relied on the trial judge’s endorsement dated 24.01.2025, confirming timely filing. 

The court further held that the trial court has the authority to remand the accused until the chargesheet is verified and cognizance is taken.

Hence, the bail plea was rejected.
