Leave Encashment is a Constitutional Right under Article 300A : Karnataka High Court

The Karnataka High Court held that an employee who has been dismissed from the service is still entitled to encashment of privilege leave as a constitutional property under Article 300A. 

G. Linganagouda, a former assistant manager at Garima Bank was dismissed after disciplinary proceedings over misconduct allegations.

His request for encashment of 220 days was denied by the bank under Pragathi Krishna Gramin Bank Service Regulations, 2013.

The Court cited that Regulation 67 does not permit taking away the employee’s right to encashment of privileged leave and directed the bank to process the leave encashment.
