Karnataka HC Seeks Centre’s Respone on PIL to Appoint Experts to Examine Electronic Evidence

  • Case Name: Srinivas v Union of India

The Karnataka High Court issued notice to the Union of India in a plea seeking more experts under Section 79-A of the Information Technology Act to certify electronic evidence. 

The petitioner argued that under Section 63 of the Bhartiya Sakshya Adhiniyam, 2023, an expert’s certificate is mandatory for submitting electronic evidence, but Karnataka has only one examiner for the entire state. 

This causes difficulties for people in remote districts.

The Court acknowledged the public importance of the issue and asked the Union to respond by February 20, 2025.
