The Karnataka High Court upheld the amendments to the Karnataka Civil Courts Act, 1964 and the Karnataka High Court Act, 1961 regarding appeals from Civil Judges (Senior Division) to District Courts, and first appeals from City Civil Courts to the High Court, irrespective of pecuniary limits.
At the same time, the Court struck down the 2007 amendment to the Civil Courts Act.
The ruling followed a petition challenging the recent amendments, contending that they infringed upon the petitioner’s substantive right to access the forum of appeal. The High Court dismissed this challenge and allowed the amendments to stand.
