Karnataka High Court inquires if victim and witness statements can quash an FIR

The Karnataka High Court is currently examining a plea by former Chief Minister BS Yediyurappa to quash an FIR filed against him under the Protection of Children from Sexual Offences (POCSO) Act. 

The FIR, lodged in March 2023, alleges that Yediyurappa sexually assaulted a 17-year-old girl who visited his residence with her mother. 

The court inquiry centres whether the FIR can be dismissed based solely on witness statements that deny the incident, emphasizing that such statements require thorough examination during trial proceedings. 

It references Section 482 of the CrPC, which allows quashing FIRs to prevent misuse of legal procedures, as seen in the Shaileshbhai Ranchhodbhai Patel Case.
