Karnataka High Court: Injunction Cannot Be Issued Against Non-Parties, Relief to BTV Kannada

The Karnataka High Court ruled that temporary injunctions under Order 39 Rules 1 and 2 CPC cannot be passed against persons who are not parties to a suit.

Justice M. Nagaprasanna allowed BTV Kannada’s petition challenging an ex parte order that blocked its social media pages.

The Court held that the trial court violated Order 39 Rule 3 and principles of natural justice by passing an injunction without impleading BTV as a party.

The court imposed ₹50,000 in costs on the plaintiff and stated that no orders can be issued against BTV unless it is properly included as a party in the case.
