Karnataka High Court Orders FIR Against Fortis, GM Hospital Doctors for Surgery Without Consent

  • Case Name: Vikas M Dev v. State of Karnataka & Others

The Karnataka High Court has directed police to register an FIR against two doctors, one from GM Hospital and another from Fortis, for allegedly conducting surgical procedures without consent, leading to a patient’s death.

The victim’s son, Vikas Dev, claimed his father suffered complications because an HD catheter insertion was done on the wrong side at GM Hospital, followed by a second unauthorised procedure at Fortis, resulting in hemopneumothorax and cardiac arrest. 

Justice M. Nagaprasanna highlighted that such medical negligence violates the patient’s right to life and dignity as guaranteed by Article 21 and ordered the FIR within 2 weeks.
