Karnataka High Court Prohibits 'Strip Search' for Transgender Survey

The Karnataka High Court has restrained the State government and authorities conducting the 'Transgender survey' from using the strip search method. Furthermore, all information collected through the survey shall be kept strictly confidential.

The decision came in hearing a petition filed by Anita Humanitarian Foundation who sought to quash the notifications issued by the State for conducting the 'Gender Minority Survey.'

It contended that the same was ultra vires to the Transgender Persons (Protection of Rights) Act 2019 and violative of Articles 14 and 21 of the Constitution.

The petition also seeks establishment of a compensation and rehabilitation fund for all transgender and gender diverse individuals who were subject to the humiliation of strip checking.
