Karnataka High Court Quashed FEMA Case Against Greenpeace Environment Trust Registered By ED

The Karnataka High Court quashed a 2019 Enforcement Directorate (ED) complaint against Greenpeace Environment Trust and Greenpeace India Society for alleged FEMA violations.

Justice Suraj Govindraj held that Section 6(3)(b) of FEMA, the provisions invoked by ED, had already been omitted with effect from October 15, 2019, before the complaint was filed.

The Court also relied on a prior ruling quashing proceedings against former Greenpeace director Kshitija Urs and also set aside a 2020 show cause notice issued by the ED. (Greenpeace Environment Trust v. UOI)
