
The Karnataka High Court has quashed an FIR against three Muslim men booked for distributing Islamic pamphlets within the premises of a Hindu temple, holding that no criminal offence was made out.
The Court observed that there was no intent to outrage religious feelings or disturb public peace, a necessary element under Section 299 BNS.
Finding no deliberate provocation or unlawful conduct, the Court ruled that the FIR and the resulting chargesheet stood vitiated. The court emphasised that mere pamphlet distribution, without intent to incite, cannot amount to a criminal act.
