Karnataka High Court Urges Amendments to Civil Procedure Code for Faster Partition Suit Resolution

The Karnataka High Court has urged the legislature to amend the Civil Procedure Code, 1908, to ensure faster disposal of final decree proceedings in partition suits.

Citing Shub Karan Bubna v Sita Saran Bubna (2009), the Court emphasised the need for a continuous and smooth process from filing the suit to granting relief.

The Court also identified areas requiring stronger legislative support, including proceedings for mesne profits and the deposit of the preliminary decree holder’s profit share.
