Karnataka High Court Rules Employees of Media Academy, Temperance Board Not Eligible for Government Pension

The Karnataka High Court held that employees of the Karnataka Media Academy and the Karnataka State Temperance Board are not government servants and therefore cannot claim pension under Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957 (KSCR).

The Court was dealing with State appeals against a single-judge order that had directed payment of pension and arrears to these employees.

It noted that neither the bye-laws nor any executive order made their service pensionable, and referred to Rule 222 of the KSCR, which limits pension to government servants.

The Court directed the government to consider their pension request and pass an informed order within four months.
