The Karnataka High Court has stayed the State Health Department’s order to close Jan Aushadhi Kendras (JAKs) in government hospitals, granting relief to 18 aggrieved petitioners. Justice M.I. Arun ruled that their pharmacy concessions will remain valid until the next hearing.
The petitioners contended that the Government Order (GO) was issued in a rushed manner, thereby violating Article 19(1)(g) and Article 21, citing investments, licenses, and the public’s access to affordable medicines.
Petitioners also pointed out that similar stores like Janasanjeevini are allowed to operate. The State defended the order based on hospital policy. The matter will now proceed to a further hearing.
Petitioners emphasised that closing JAKs will harm public health and access to affordable medication.
