Police Cannot Summon Advocates to Disclose Client Confidential Information : Kerala High Court

The Kerala High Court has ruled that police lack the authority to summon an advocate for information regarding their client, as this infringes on constitutional rights and violates the principle of privileged communication.

The Court observed that such actions could undermine the client's right to representation and the advocate's professional stature.

The court emphasized that under Section 132(1) of the BSA, no advocate can be compelled to disclose communications made by their client during professional engagement.

This ruling came after an advocate was summoned under Section 35(3)  BNSS in connection with a case involving alleged Bangladeshi nationals accused of forging documents to reside in India.
