
The Kerala High Court ruled that a husband restricting his wife’s movements and compelling her to resign from her job amounted to mental cruelty.
The bench observed that constant suspicion and monitoring of a spouse’s life eroded the foundation of marriage, which depends on mutual trust, respect, and emotional security.
The Court found that such controlling conduct violated the wife’s personal autonomy and dignity, justifying divorce. The Court held that interference with a partner’s independence and livelihood constituted serious psychological harm.
Consequently, the Court allowed the wife’s appeal, set aside the family court’s order, and dissolved the marriage between the parties.
