The Court noted that inaction violated constitutional rights and denied equal opportunities to transgender persons due to societal and structural disadvantages.
Despite the 2019 Transgender Persons (Protection of Rights) Act and Kerala’s 2020 rules, no provisions or orders for reservations existed, causing continued exclusion.
The Court ordered the State to act promptly to address these inequalities and ensure transgender inclusion in education and public employment.
