The Kerala High Court held that geographical restrictions on prisoners' visits to their relatives, while accompanied by police escorts, do not violate the fundamental rights of prisoners.
The Kerala High Court upheld Rule 415(3) of the Kerala Prisons and Correctional Services (Management) Rules, 2014.
The court highlighted that these restrictions are based on practical considerations, such as security, financial burden, and state resources, aligning with Articles 14, 15, and 19(1)(d), of the Constitution.
A UAPA-accused petitioner argued the rule was discriminatory, but the court clarified it only imposes geographical limits, not discrimination, and is consistent with prison management policies.
The rule was found constitutional.
