The Kerala High Court has held that a civil court decree passed in a company’s former name continues to remain valid and enforceable even after the company changes its name.
The Court clarified that a mere name change does not create a new legal entity, the company’s legal identity remains the same.
This decision came in a case where execution of a decree was challenged on the ground that the name of the decree-holder company had changed.
Thus, finding that no substantial question of law arises for consideration, it dismissed the appeal.
