
The Kerala High Court struck down several provisions of a state circular that banned automatic and electric vehicles for Light Motor Vehicle (LMV) driving license tests, holding them ultra vires Section 12 of the Motor Vehicles Act, 1988.
The court ruled that only the Central Government has rule-making powers regarding driving schools.
The Court also invalidated rules on mandatory leg-gear bikes above 95cc, disqualification of vehicles over 15 years old, and compulsory camera-tracking in test vehicles.
The circular was found to violate Articles 19 and 21, with State measures deemed beyond its legal authority.
