Kerala High Court: Disabled Employee Can’t Be Penalised for Lack of Accessible Infrastructure

The Kerala High Court ruled that a government employee with disabilities should not suffer due to the state's failure to provide accessible infrastructure.  

The case involved T. Rajeev, a Senior Grade Typist with 60% locomotor disability, who was unable to access his office on an upper floor.  He requested a transfer to a ground-floor position with pay protection. Although the transfer was granted, his salary was reduced.  

The Court held that this violated the Rights of Persons with Disabilities Act, directing the government to protect his pay and ensure reasonable accommodation and accessibility in public offices.
