
The Kerala High Court has ruled that an allegation of false promise of marriage is not legally tenable if the complainant was already in a subsisting marriage during the relationship.
The court emphasised that such a promise, even if made, cannot be considered legally binding or enforceable under the Indian Penal Code (IPC) when the victim lacked the capacity to marry due to an existing marital bond.
The bail was granted with conditions, requiring Petitioner to cooperate with the investigation, refrain from contacting the complainant, and remain in India unless permitted by the Court.
