Kerala High Court Sets One-Week Timeline for Guidelines on Appointing Public Prosecutors

The Kerala High Court has directed the State to frame guidelines within one week for appointing Public Prosecutors under Section 18 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023

The Bench cautioned that coercive orders may follow if the State fails to comply. The direction came in a PIL alleging that the absence of transparent criteria has led to arbitrary and politically influenced appointments. 

The Court noted that despite its April 2025 order, no guidelines were issued, and that recent recruitment notices lacked the objective standards required under the BNSS framework.
