The Court noted that not every failed relationship is rape and highlighted Supreme Court concerns over the misuse of sexual assault laws; the case involves sexual assault, forced abortion, and video threats.

The Kerala High Court on Thursday granted anticipatory bail to MLA Rahul Mamkootathil in one of three rape cases, imposing strict conditions including surrender of his passport, regular police appearances, and full cooperation with the investigation.
Justice Kauser Edappagath noted the complainant had a prior consensual relationship with Mamkootathil, stayed with him after the incident, and took abortion pills voluntarily, prima facie indicating consent.
Mamkootathil had already secured bail in the other two cases and was suspended from Congress following the complaints.
