Kerala High Court: Magic Mushrooms Not A Narcotic Substance Under NDPS Act

The Kerala High Court clarified that magic mushrooms are not narcotic or psychotropic substances under the NDPS Act.

Justice PV Kunhikrishnan ruled that psilocybin, naturally occurring in magic mushrooms, does not make the fungi a drug mixture.

The Court emphasized that only the psilocybin content, around 1% per gram, should be considered for determining contraband quantity.

This decision came during a bail hearing for a man arrested with small amounts of charas, ganja, and psilocybin-contained mushrooms.

The Court granted bail, noting the absence of prior criminal history and the accused's 90-day custody.
