Kerala High Court Quashes Interim Maintenance Order for Violating Supreme Court Guidelines

The Kerala High Court directed all state courts to strictly follow the Supreme Court guidelines from Rajnesh v. Neha (2021) 2 SCC 324 when handling maintenance cases under Section 125 CrPC.

The Kerala High Court canceled a family court order in Kollam that directed a man to pay ₹5,000 monthly to his wife and child as temporary financial support without verifying both sides' income and assets.

The husband challenged the order, arguing it violated Supreme Court mandates.

The court stressed that both parties must disclose their financial details before deciding on maintenance and sent the case back to the family court for a fresh decision.
