Kerala High Court Stays Loan Recovery from 2024 Wayanad Landslide Victims

The Kerala High Court stayed the recovery of loans from victims of the 2024 Wayanad landslides, despite the Central government denying such waivers.

The decision arose from a suo motu petition addressing rehabilitation for displaced victims.

The Court impleaded 12 major banks as respondents, and directed them to file affidavits on their willingness to grant partial or full loan waivers.

The Court also criticised the Union government’s stance, stating it violated the principle of separation of powers, and emphasised that Part III of the Constitution imposes a duty on the State to protect citizens’ fundamental rights.
