
The Kerala High Court held that tribunals and quasi-judicial authorities cannot dispose of matters through cryptic or non-speaking orders without providing reasons.
The Court emphasised that reasoned orders are essential for transparency, fairness, and proper judicial review. It observed that parties have a right to know the basis of decisions affecting their rights and liabilities.
Setting aside the tribunal’s order, the High Court reiterated that recording reasons reflects proper application of mind and forms a fundamental part of the justice delivery system.
