Uniform Format for Settlement Terms in Judicial Orders Not Feasible : Kerala High Court

The Kelera High court in its ruling observed that is not feasible to issue judicial directions prescribing a specific format for judicial orders, in the absence of statutory backing.

Order came in regard to a suo moto petition initiated by the Registry seeking to establish a uniform practice and procedure for incorporating settlement terms while preparing judgments, decrees, and orders in cases settled by mediation etc.

The Court stated that incorporating terms of settlement in judgments, decrees and orders would depend upon the 'nature of cases' and 'consent of parties' where no legal impediment exists.

Section 89 of the CPC was focused upon, in this regard.
