Kerala HC Upholds Body Donation of Late CPI(M) Leader to Medical College

MM Lawrence, a CPI(M) leader, passed away on September 21, 2024. His daughter, Asha, opposed donating his body to Ernakulam Medical College, seeking a Christian burial, while other family members and the CPI(M) supported the donation, citing a signed consent form.

The case centred on the validity of Lawrence's consent for donation and procedural issues. Asha argued the consent was invalid, the hearings were biased, and her sister’s withdrawal of consent was ignored, while the respondents upheld the donation based on the consent form and expert review.

The Division Bench dismissed Asha’s appeal, upholding the donation’s legality under the Kerala Anatomy Act.
