Knowing a Woman Doesn’t Give License to Rape: MP High Court Refuses to Quash FIR

The Madhya Pradesh High Court has dismissed a plea to quash a rape FIR, stating that knowing a woman does not give a man the 'license'  to commit rape.

In this case, the victim alleged that the accused, known to her for three years, forcibly took her to a field and raped her, threatening that in case she disclosed the incident, then he would kill her. 

The accused argued that the FIR was filed two months after the incident and claimed a consensual relationship based on photos. 

However, the Court held that a delay in lodging an FIR does not invalidate it and that prior familiarity does not imply consent. Consequently, the application to quash the FIR was dismissed.
