Lack of Injury Not Ground to Deny Compensation in POCSO Penetrative Assault Cases: Allahabad High Court

The Allahabad High Court held that compensation to a child victim of penetrative sexual assault under the POCSO Act cannot be denied merely because the medical report does not record injury to the private parts.

The Court noted that under Section 3 of the POCSO Act, penetrative sexual assault does not necessarily result in physical injury.

It observed that compensation under the Uttar Pradesh Rani Lakshmi Bai Mahila Samman Kosh Rules, 2015 is payable due to the commission of the offence itself.

The Court further held that steering committees cannot reassess evidence like a trial court and directed immediate payment of ₹3 lakh compensation to the victim.
