Lawyers not immune from prosecution merely due to professional status : Supreme Court

The Supreme Court has refused to quash criminal proceedings against a lawyer accused of conspiring with the main accused in a case.

A Bench of Justices Pankaj Mithal and PB Varale clarified that lawyers are not above the law and can be prosecuted if incriminating material surfaces, including phone conversations. 

The Court observed that even telephonic advice may attract liability if it appears criminal in nature, adding, “Lawyers will now be careful.” 

The petition challenging the proceedings was dismissed, with the Court holding that such issues must be tested during trial.
