
The Gujarat High Court held that merely having an LL.B degree cannot be a ground to deny maintenance to a divorced wife.
The Court upheld a Family Court order granting ₹10,000 per month, observing that a woman’s educational qualification or earning capacity alone does not disentitle her from maintenance.
It noted that maintenance depends on factors like the husband’s income and overall circumstances.
Finding the amount reasonable, around one-third of the husband’s assessed income, the Court refused to enhance it, while reaffirming that a husband’s duty to maintain his wife continues even after divorce.
