  • Case Name: Hardev Singh Akoi Vs Jasdev Singh Akoi
  • Judge(s): Justice Mini Pushkarna
  • Advocate(s): Ajoy Bhushan Kalia, Sanjay Upadhyay and others

Delhi HC resolves 16-year-old Imperial trademark dispute. The dispute arose due to disagreements between joint owners, brothers Hardev Singh Akoi and Jasdev Singh Akoi, over trademark modifications, including the introduction of an elephant logo by Jasdev.

In 2008, the Court restrained Jasdev Singh from altering the trademark without Hardev Singh's consent. The matter was referred to mediation and concluded with a settlement.

To formalize the settlement, applications under Order I Rule 10(2) and Order XXIII Rule 3 of the CPC, along with Section 151, were filed to add plaintiffs, record the terms, and dispose of the case.
