Machinery Needed For Citizens To File Complaints Against Misleading Medical Ads : Supreme Court

  • Case Name: Indian Medical Association v. Union of India
  • Judge(s): Justices Abhay S Oka and Ujjal Bhuyan

The Supreme Court stressed the need for a mechanism to allow citizens to file complaints against misleading medical advertisements.

A bench emphasized the importance of the Drug and Magic Remedies (Objectionable Advertisements) Act and criticized Karnataka for failing to prosecute 25 cases due to a lack of material particulars (such as license no.).

The court directed the Karnataka government to identify offenders and submit a compliance report within a month.

The Court also dealt with the issue concerning compliance with Rule 170 of the Drugs and Cosmetics Rules, affecting multiple states, and will revisit the issue on March 7.
