Definition of "Victim" Does Not Cover Past Victims of Accused under Section 339 of BNSS

  • Case Name: Ismile Shah Vs The State of Madhya Pradesh
  • Judge(s): Justice Maninder S. Bhatti

The Madhya Pradesh High Court ruled that individuals harmed by an accused in the past cannot automatically object to new criminal cases against them.

Citing Section 2(y) of BNSS, the court clarified that the legal definition of "victim" pertains only to harm suffered in the current case.

In this case, an individual attempted to object to a new case against someone they claimed to have been victimized by in the past.

However, the court dismissed their objection, stating that the objector lacked standing under Section 339 of BNSS and Section 301(2) of CrPC. Additionally, they had no direct connection to the alleged offense and a history of filing multiple cases, raising doubts about their motives.
