Madras HC Criticises National Medical Commission for Calling Gender Identity a ‘Disorder’

  • Case Name: S. Suhma vs. Director General of Police & Ors

The Madras High Court criticised the National Medical Commission (NMC) for continuing to use the term “gender identity disorder” in its proposed medical curriculum, stating it negates efforts taken by the court to bring change for LGBTQIA+ rights.

The Court remarked that gender identity is not a disorder but a created by nature and urged NMC to revise its approach.

The Court also questioned NMC’s reluctance to include LGBTQIA+ topics in medical education, arguing that schools lack the scientific temperament to teach such subjects.

Additionally, it directed the State to present two proposed transgender policies for discussion, emphasising the need for a consolidated approach.

The case was adjourned to February 17, 2025.
