The Madras High Court has ruled that transferring employees, especially women, without considering their family responsibilities, health issues, or safety, can violate Article 21 of the Constitution, which guarantees the right to life and human dignity.
While addressing a challenge to Union Bank of India’s staff transfer policies, the court noted that these policies disproportionately affect women and urged the bank to implement safeguards, incorporating measures like in-zone transfers, counseling, and extended joining periods.
The court also emphasized adherence to the Finance Ministry's directives, which advocate for minimizing hardships faced by female employees during transfers.
