The Madras High Court ruled that a Hindu marrying a foreigner cannot register their marriage under the Hindu Marriage Act, as both must be Hindu at the time of marriage.
The court advised that such marriages should be registered under the Special Marriage Act to avoid legal issues.
The case involved a Hindu wife challenging a Family Court order that declared her marriage to a Christian man void.
The husband argued the marriage was invalid as it wasn’t under the Special Marriage Act, while the wife claimed it followed Christian customs and shouldn’t be invalid due to non-registration.
