The Madras High Court directed actor-politician Vijay and his party, Tamilaga Vettri Kazhagam (TVK), to respond to an appeal over alleged trademark infringement of its party flag.
The appeal, filed by GB Pachaiyappan and his trust, challenges a single judge’s refusal to restrain TVK from using its flag, which they claim resembles their registered red-yellow-red tricolour with a central motif.
They argue the similarity infringes their trademark and copyright, creating public confusion. TVK denied copying and highlighted distinct symbolism.
A Division Bench will hear the matter after six weeks, while the single judge will proceed with the main suit.
