The Madras High Court has closed the petition of transgender Sub-Inspector Priyanka Yashini, who challenged the Central Adoption Resource Authority’s (CARA) rejection of her adoption application.
Justice M. Dhandapani observed that current CARA regulations do not recognise transgender individuals as prospective adoptive parents.
The Court directed Yashini to approach the Union Ministry of Women and Child Development to seek an amendment to Regulation 5 of the Adoption Regulations to allow adoption by transgender persons.
The Ministry has been asked to consider her request and pass orders within 12 weeks.
